1 Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Fluenk, operated by Gabriele Dell'Aria ("we", "us", or "our"), available at fluenk.gabrieledellaria.dev.

By creating an account, accessing, or using any part of Fluenk, you confirm that you are at least 16 years of age and that you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the platform.

2 Description of Service

Fluenk is a web-based influencer discovery, ranking, and campaign management platform. Its core features include:

• A proprietary Fluenk Score (0–100) that aggregates public social media metrics — including followers, engagement rate, and platform reach — across TikTok, Instagram, YouTube, Facebook, X, LinkedIn, Twitch, Threads, and Pinterest.
• A public creator ranking focused on influencers based in Palermo and Sicily.
• A Brand Dashboard for managing influencer lists, marketing campaigns, creator applications, and deliverables.
• A Creator Dashboard for monitoring performance, applying to brand campaigns, and managing a portfolio.
• Gamification features including credits, badges, streaks, and predictions.
• Community features for verified creator accounts (chat, clubs, collaborations).

We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.

3 User Accounts

To access most features you must register for an account. You agree to:

• Provide accurate and complete information during registration.
• Keep your password confidential and not share it with third parties.
• Notify us immediately of any unauthorized use of your account.
• Be responsible for all activities that occur under your account.

Fluenk offers four account types: User (public access), Creator (verified influencers, admin-approved), Brand (businesses, admin-approved), and Admin. Creator and Brand accounts are granted at our discretion.

We reserve the right to suspend or terminate accounts that violate these Terms.

4 Third-Party Platform Data (including TikTok)

Fluenk integrates with third-party platforms — including TikTok — to enrich creator profiles with public social media data. When you connect your TikTok account to Fluenk, we may access:

• user.info.basic: your TikTok display name, profile picture, and account identifier, used to display and verify your Fluenk creator profile.
• video.list: your most recent public TikTok videos, displayed on your Fluenk profile so brands can evaluate your content.

This data is used exclusively within Fluenk to populate and verify creator profiles. It is never sold, shared with third parties, or used for advertising purposes. You may revoke TikTok access at any time from your TikTok account settings, and your connected data will be removed from Fluenk upon request.

Your use of third-party platforms remains subject to the respective platform's terms of service and privacy policies.

5 Acceptable Use

You agree not to use Fluenk to:

• Violate any applicable law or regulation.
• Impersonate any person or entity or falsely claim an affiliation.
• Submit false, misleading, or fraudulent information about yourself or your social media profiles.
• Scrape, harvest, or extract data from the platform by automated means without our express written permission.
• Interfere with or disrupt the security, integrity, or performance of the platform.
• Transmit spam, unsolicited messages, or malicious code.
• Attempt to gain unauthorized access to other user accounts or platform systems.

Violation of these rules may result in immediate suspension or termination of your account without notice.

6 Intellectual Property

All content, design, code, logos, trademarks, and features of Fluenk are the exclusive property of Gabriele Dell'Aria and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

By submitting content to Fluenk (such as portfolio items, campaign descriptions, or posts), you grant us a non-exclusive, royalty-free license to display that content within the platform for the purpose of providing the service.

7 Privacy

Your use of Fluenk is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand how we collect, use, and protect your data.

8 Disclaimers

Fluenk is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The platform will be uninterrupted, error-free, or secure.
• The Fluenk Score or any metrics are accurate, complete, or suitable for any particular purpose.
• Data retrieved from third-party platforms (including TikTok, Instagram, and YouTube) is current or accurate, as it depends on external APIs and scraping that may be subject to change.

Social media metrics displayed on Fluenk are collected automatically and are intended as indicative data only.

9 Limitation of Liability

To the fullest extent permitted by law, Gabriele Dell'Aria shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of — or inability to use — Fluenk, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.

10 Termination

You may delete your account at any time by contacting us. We may suspend or terminate your access at our sole discretion, without prior notice, if we believe you have violated these Terms.

Upon termination, your right to use the platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will remain in effect.

11 Governing Law

These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Palermo, Italy.
